GENERAL CONDITIONS OF PURCHASE
Gallery Collection is a brand of PopTheQuestion Srl. POPTHEQUESTION SRL, (PTQ) a firm headquartered in Rome, Via Casilina Vecchia n. 27, C.F. and P.IVA n.13214871009, in the name and on behalf of legal representative Candidi Nicola (C.F. CNDNCL83P11H501W), is a firm that designs, produces and sells through its website www.gallerycollection.it, or sites related to it, paper products related, by way of example, to the world of wedding invitations, baptisms, and ceremonies in general.
By purchasing PTQ products from www.gallerycollection.it, the Buyer declares that he/she is aware of and accepts the following general terms and conditions of sale.
FOREWORD: how to access the purchase.
The products are purchasable only and exclusively through the website www.gallerycollection.it or websites linked to it and only by following the step-by-step procedure therein.
1. Purchasing the product
The Buyer, having made the payment, will receive from Gallery Collection a confirmation of shipment by express courier, which will take place within a maximum of 10 working days from the purchase.
2. Terms and methods of payment
Payment must be made by bank transfer or credit card at www.gallerycollection.it or other sites linked to it, as expressly indicated on the page of the site dedicated for this purpose. Confirmation of payment will initiate shipment.
3. Shipping the finished product
PTQ agrees to deliver the finished product to the courier for shipment within 10 working days of purchase. The shipment will be made by national express courier, at a variable cost depending on the destination and that will be defined from time to time in the order confirmation. The customer may decide to insure the shipment, up to a total value of €500 (including VAT), the cost of which will vary depending on the destination.
4. Obligations of the customer/buyer
For the purposes of this contract, the Customer represents, covenants, and warrants:
- To have the power and authority to enter into this Contract;
- To be at least eighteen (18) years old;
- to access and use all Services provided by PTQ only and only in accordance with this Agreement and applicable law.
During the execution of its order, the Customer is to be held solely responsible for any infringement of the rights of third parties, in particular copyrights, of which rights it claims to possess for the purpose of duplication of reproduction of third party materials. It is entirely excluded any liability of PTQ for cases of publication not expressly authorized by third parties, of the texts entered by the Customer in any area, public, private or telematic. It is understood that the Customer exonerates and agrees from the outset to indemnify and hold PTQ harmless from any claims from third parties due to any infringement of such rights.
5. Exercise of the right of withdrawal and complaints
In adherence to the rules set forth in the “Consumer Code” and in particular Article 64, the buyer has the right to withdraw without penalty and without specifying the reason, within the period of ten (10) working days, from the receipt of the goods.
The right of withdrawal is exercised by sending, within the prescribed time, a written notice to the professional’s office by registered letter with return receipt.
In the event of withdrawal and/or promptly reported complaints, the Customer is obligated to return, at his or her own expense, all undamaged material that is the subject of the complaint and to indemnify PTQ for the expenses and costs incurred by PTQ in making the product.
6. Product optimization
Structure cuts may undergo minor changes over time, dictated by technical reasons for optimization and qualitative/aesthetic improvement of the product.
7. Responsibilities of PTQ
PTQ disclaims any responsibility for delays, malfunction, suspension and/or interruption in service delivery caused by:
- force majeure;
- malfunction or non-conformity of the connection equipment with which the Customer has been equipped;
- Inefficiencies attributable to third parties independent of PTQ.
In any case, PTQ’s liability is limited to reprinting or remaking items with errors or defects that make the finished product differ from the Customer’s approved preview.
8. Express termination clause
If 15 days have elapsed since the purchase request and the Customer has not made payment, the contract shall be deemed to be terminated by right pursuant to Article 1456 of the Civil Code.
9. Domicile of the parties
Any communication required or permitted shall be made in writing by registered mail with return receipt or by electronic means to the addresses indicated.
10. Privacy and Use of Cookies on the gallerycollection.co.uk website
Personal data sent to gallerycollection.co.uk will be processed in accordance with current regulations.
